Dank, Esq., P.C. was successful on behalf of cooperative apartment owner as against the cooperative building after conducting an eleven (11) day bench trial as a result of the cooperative building’s breach of proprietary lease in which the Court awarded him reimbursement of maintenance paid from January 2023 and abated the payment of monthly maintenance ongoing until his apartment is made wholly tenantable.

Our Firm was granted a money judgment on behalf of Plaintiff/Landlord as against Defendants/Tenants and Personal Guarantor pursuant to a Commercial Lease Agreement for past due rent and additional rent due and owing.

Breach of Contract Action
Warren S. Dank, Esq., P.C. defeated Defendant’s attempt to reargue the Appellate Division’s reversal of the Supreme Court’s Decision dismissing Plaintiff’s Breach of Contract Action after a Bench Trial and obtained a Money Judgment for Plaintiff against Defendant in the sum of approximately $484,000.00.

Our Firm commenced a commercial mortgage foreclosure action on behalf of Lender against Borrower. Our firm filed a Motion for a default judgment and for an appointment of a Referee to compute amount due and owing the Lender which the Court granted.

Successful in Seeking an Award of Attorneys’ Fees
Warren S. Dank, Esq., P.C. was successful in seeking an award of attorneys’ fees for our client, Plaintiff, pursuant to the Court’s prior Order in which summary judgment was granted in Plaintiff’s favor.
Personal Guarantors Pursuant
Our Firm was granted a default judgment on behalf of Plaintiff/Landlord as against Defendants/Tenants and Personal Guarantors pursuant to a Commercial Lease Agreement for past due rent and additional rent due and owing in the amount of $436,274.24.
Pursuant to a Promissory Note
Warren S. Dank, Esq., P.C. brought an action on behalf of Plaintiff/Lender relating to money owed pursuant to a Promissory Note. The Court granted our firm Summary Judgment against Defendants awarding the balance due and owing under the Promissory Note with applicable interests and costs and Ordered an Inquest on accessing damages for reimbursement of attorneys’ fees.
