Personal Guarantors Pursuant
Our Firm was granted a default judgment on behalf of Plaintiff/Landlord as against Defendants/Tenants and Personal Guarantors pursuant to a Commercial Lease Agreement for past due rent and additional rent due and owing in the amount of $436,274.24.
Pursuant to a Promissory Note
Warren S. Dank, Esq., P.C. brought an action on behalf of Plaintiff/Lender relating to money owed pursuant to a Promissory Note. The Court granted our firm Summary Judgment against Defendants awarding the balance due and owing under the Promissory Note with applicable interests and costs and Ordered an Inquest on accessing damages for reimbursement of attorneys’ fees.

Warren S. Dank, Esq., P.C. commenced a commercial mortgage foreclosure action against Defendant-Borrower. Our firm moved for a default judgment as to liability in favor of Plaintiff as against Defendant-Borrower and for an appointment of a Referee to compute pursuant to RPAPL & 1321 in which the Court granted Plaintiff’s motion on default.
Plaintiff’s Motion for Summary Judgment
The Court granted our Firm Summary Judgment against Defendant Commercial Borrower striking their Answer and granted an Order of Reference to Appoint Referee to compute amount due and owing Plaintiff Lender.
